서울시가 문화재청의 반대에도 불구하고 국보 제1호 숭례문(남대문)에 대한 치밀한 문화재 방재시설을 확보하지 않고 밀어붙이기식으로 남대문을 개방한 것으로 드러났다. 시민들에게 뭔가 한 건 보여 주려한 서울시의 무리한 선심성 전시행정과 문화재 당국의 무책임에 의해 숭례문이 희생됐다는 지적이다.
숭례문은 이명박 당시 서울시장의 주도로 2006년 6월 28일부터 전면 개방됐다. 2005년 5월 숭례문 앞 잔디광장을 조성해 개방한 데 이어, 2006년부터 숭례문의 중앙 통로인 홍예문(虹霓門) 안까지 공개한 것이다. 2층의 문루(門樓)는 문화재 보존ㆍ관리 차원에서 개방하지 않았다.
숭례문 개방은 서울시 문화재위원회가 문화재청에 공문을 보내 개방을 요청하는 식으로 이뤄졌다. 당시 문화재청은 숭례문의 안전문제 등을 들어 미온적인 태도를 보였으나 서울시는 시민들에게 굵직한 성과물을 내놓고 싶었던 나머지 끈질기게 숭례문 개방을 요구했다.
문화재 당국자는 “숭례문 개방 문제로 인해 문화재청과 서울시 사이에 공문이 오랫동안 왔다 갔다 했다”고 말했다.
문화재청은 이번 화재 발생 직후 숭례문의 관리 주체가 아니라는 점을 들어 책임 회피에 급급했다. ‘국보 1호’임에도 관리 주체는 정부는 커녕 기초자치단체인 서울 중구청 공원녹지과의 일개 팀이었다.
문화재청 당국자는 이번 사고를 예산과 인력 부족 탓으로 돌렸다. 문화재청 당국자는 “문화재청 예산은 4천800억원밖에 안 된다. 인원도 750명이 전부”라고 말했다. 또 “방재는 중구청에서 당연히 했어야 했다”고 덧붙였다.
현재로서는 문화재 관리를 소홀히 하는 기초자치단체에 대해 강제력을 행사할 근거도 미약하다. 문화재청은 기초자치단체에 협조 공문을 보내는 것으로 그치고 있다. 문화재 관계자는 “전국의 시군구 문화재 담당부서는 우리 (문화재청) 조직이 아니기 때문에 그쪽에 이래라 저래라 할 수도 없는 노릇”이라고 말했다. 이어 “우리 조직도 아닌 데 누가 우리 말을 제대로 듣겠느냐”고 하소연했다.
문화재청은 경복궁 등 궁과 릉 등에 직할 관리사무소를 두고 있을 뿐 이외의 문화재에 대해서는 제 아무리 국보나 보물이라고 해도 문화재청의 1차 소관이 아니라는 입장이다.
하지만 일선 시군구의 문화재 관리 부서는 6~8급의 하급직 공무원 몇명이 관내 문화재의 관리ㆍ보수 업무는 물론 다른 시설관리 업무까지 도맡아 하고 있다. 서울 중구청 공원녹지과 시설관리팀은 국보 1호 숭례문 이외에도 목조 건축물인 사적 157호 환구단을 관리해오고 있다.

[나의 문화유산 답사기]의 저자이기도 했던 유홍준 문화재청장(사진)이 12일 숭례문 화재 소실과 관련, 책임을 지고 문재인 청와대 비서실장에게 사표를 제출했다. 노무현 대통령은 유 청장의 사표를 조만간 수리할 예정인 것으로 알려졌다.유 청장은 이에 앞서 이날 오전 청와대에서 열린 국무회의에 참석, '숭례문 화재 상황 및 후속조치 계획'에 대해 보고했다고 천호선 청와대 홍보수석 겸 대변인이 전했다. 유 청장은 보고에서 "국보를 제대로 지키지 못한데 대해 문화재청장으로서 사과의 말씀을 드린다"며 화재 발생과 진화 과정, 복구 방향, 재발방비 대책에 대해 보고했다.재발 방지 대책과 관련해서는 △불비한 법률체계 정비를 통한 소방시설 확충 제도화 △2005년 4월5일 낙산사 화재를 계기로 수립한 중요 목재 문화재 124건에 대한 방재대책 재점검 △적외선 등 문화재 침입 조기 경보시스템 구축 △수막설비 등 외국 첨단 방재시설 도입 및 운용 △지방자치단체가 관리하는 국가지정 문화재 경보·방재 시스템을 문화재청이 직접 관리하는 방안 등이 보고됐다.
이에 대해 노무현 대통령은 "지난 낙산사 화재 사고 이후로 수립한 목조 문화재 관련 대책이 제대로 시행되고 있는지는 물론 수립한 계획 그 자체에는 문제점이나 한계가 없는지 세부 실행계획이 수립되고 이행되고 있는지 등을 검토하라"고 지시했다. 또 "특히 기존의 계획을 이행하는데 있어서 필요한 예산이나 전문인력, 기술 등 물적, 인적 지원에 대한 계획이 합당하게 세워져 있는지를 살펴보고 새로운 계획을 수립해 나가는데 있어서 이런 점들을 고려해 현실적이고 합리적인 계획을 수립하고 이를 국민들에게 소상하게 알리도록 해야 한다"고 강조했다.노 대통령은 유 청장이 사표를 제출하기 전 국무회의에서 유 청장에게 사후대책을 수립하고 실행하는데 최선을 다해 달라고 당부했다고 천 수석이 전했다.

‘묻지마 화풀이’ 국보 1호 태웠다…토지보상 불만 70대 노인 방화범

국보 1호 숭례문이 하룻밤 새 잿더미가 된 것은 한 70대 노인의 ‘묻지마식 화풀이’ 때문인 것으로 드러났다.
숭례문 화재 사건을 수사 중인 남대문경찰서는 12일 “전날 강화도 화점면에서 방화용의자 중 한명인 채모씨(70)를 붙잡아 범행 일체를 자백받았다”며 “범행 당시 입은 옷가지와 범행 때 사용하고 남은 시너(약 6ℓ) 등 증거품도 확보했다”고 밝혔다.
채씨가 이처럼 끔찍한 ‘묻지마 범죄’를 마음속에 품게 된 것은 1997~1998년 자신의 토지(약 99㎡)가 신축 아파트 건설부지에 포함되면서부터인 것으로 알려졌다. 이후 채씨는 건설사를 상대로 소송을 벌이는 것을 비롯해 고양시청과 대통령비서실 등에 수차례 진정과 이의를 제기했지만, 모두 허사로 끝나자 사회에 극단적 불만을 품게 된 것으로 경찰은 분석하고 있다.

조선초기 건물인 국보 1호 숭례문이 2월 10일 밤8시45분부터 발생하여 5여 시간에 걸친 화재로 전소됐다. 화재원인으로는 전기합선으로 추정했으나, 화재발생장소인 숭례문 2층에는 전기시설이 없는 것으로 확인되어 전기 합선요인이 화재요인이 아니라, 50대로 보이는 남자가 숭례문 2층으로 올라갔다 나온 이후로 화재가 발생했다는 현장 목격자들의 증언을 통해 방화로 인해 화재가 발생한 것으로 밝혀지고 있다. 소방당국의 초기진압이 부진한 이유로는 문화재 보호차원에서 문화재청의 조심스런 진압요청으로 인한 초기 화재진압 부진으로 결국은 숭례문 2층이 붕괴되는 등 숭례문이 거의 전소되었다. 이에 화재 진압문제와 관련하여 문화재청과 소방당국의 책임논란이 예상된다. 또한 국보 1호 문화재 보호관리와 관련하여 숭례문 내부진입을 차단하는 인원배치 부재 등 문화재 관리문제에 대한 비판과 문제제기도 예상된다.
전소된 숭례문은 조선시대 서울도성을 둘러싸고 있던 성곽의 정문으로 원래 이름은 숭례문이며, 남쪽에 있다고 해서 남대문이라고도 불렀다. 현재 서울에 남아 있는 목조 건물 중 가장 오래된 것으로 태조 4년(1395)에 짓기 시작하여 태조 7년(1398)에 완성하였다.

화재원인
숭례문 화재의 큰 불길이 잡힌 가운데 이번 화재가 방화일 가능성이 점차 커지고 있다.
숭례문 경비를 맡고 있는 KT텔레캅은 11일 밤 8시 47분쯤 경보가 발령됐다고 밝혔다.
KT텔레캅 관계자는 숭례문에 모두 6개의 적외선 감지 센서가 작동되고 있으며 8시 47분쯤 경보가 울려 보안요원을 출동시켰다고 밝혔다.
KT텔레캅 측은 센서가 촘촘히 설치되어 있어 누군가 1층에 발을 들여놓기만 해도 바로 경보가 울린다고 덧붙였다. 다만 KT텔레캅측은 CCTV가 모두 4대 설치되어 있지만 여기서는 별다른 이상을 발견하지 못했다고 설명했다.
이에 따라 이번 화재는 방화일 가능성이 점점 커지고 있는 상황이다. 누군가 화재가 일어나기 3분 전에 숭례문에 무단 침입했던 사실이 드러났기 때문이다.
방화 가능성은 최초 신고자의 진술을 통해서도 확인되고 있다.
숭례문 근처에서 승객을 기다리고 있던 택시 기사 이 모(44)씨는 "50대로 보이는 한 남성이 쇼핑백을 들고 숭례문 옆 계단으로 올라갔다"라며 "잠시 뒤 남대문에서 빨간 불꽃이 퍼져나와 신고했다"고 말했다. 이 씨는 이 남성을 따라갔지만 찾을 수 없었다는 말도 덧붙였다.
또한, 숭례문 인근의 일부 상인들은 10일 오후 4시쯤에도 노숙자 차림의 남성이 숭례문으로 들어가는 모습을 목격했다고 진술하기도 해 숭례문 보안에 구멍이 뚫린 것 아니냐는 지적도 일고 있다.
한편, 소방당국은 10일 밤 발생한 숭례문 화재와 관련, 현장에 처음으로 투입됐던 소방대원들이 발화지점으로 예상되는 곳에서 라이터 2개를 목격했다고 11일 밝혔다.
중부소방서 오용규 진화팀장은 "현장에 처음으로 들어갔던 소방대원이 계단을 타고 올라가 숭례문 2층 `큰 기둥' 아래에서 일회용 라이터 2개를 봤다고 보고했다"며 "라이터가 발견된 곳은 발화지점으로 예상되는 곳이었다"고 말했다.
오 팀장은 "상황이 급박하게 돌아갔고 대원들이 본연의 임무를 다하려고 하다가 보니 라이터를 가져오지 못했다"며 "경황이 없었지만 증거를 확보하지 못한 건 소홀한 면이 있다"고 말했다.
소방당국은 이 같은 초동보고에 따라 숭례문 화재가 방화 때문에 일어났을 가능성에 매우 높다고 보고 정확한 화인을 조사하고 있다.
오 팀장은 "숭례문에는 전기시설이 전혀 없는데 목격자가 연기가 뿜어져 나오면서 `퍽'하는 소리와 함께 형광이 보였다고 진술했고 발화지점 근처에서 라이터까지 나오니 방화 가능성을 염두에 두지 않을 수 없다"고 말했다.
그는 "소방대원들이 숭례문에 진입할 때 잠긴 문 등 차단 장치가 전혀 없었고 이는 곧 그 시간대에 일반인들이 얼마든지 마음만 먹으면 출입할 수 있었다는 걸 의미한다"고 설명했다.
숭례문 화재사고관련 괴소문과 풍수지리적 해석
숭례문·남대문 화재를 놓고 신비주의적 해석이 무성하다.
풍수지리는 서울을 관악산의 화기에 무방비로 노출된 도시로 본다. 관악산의 불기운을 누르기 위한 부적과도 같은 존재로 숭례문을 꼽는 이유다. 숭(崇)은 '높인다', 예(禮)는 음양5행 중 '불'을 뜻한다.
관악산 불에 대항하는 상징적, 인위적, 이열치열적 존재가 숭례문인 셈이다. 崇 자는 화염이 위로 솟구치는 꼴이기도 하다. 더욱 활활 타오르도록 여느 현판과 달리 '숭례문' 석 자를 세로로 써내렸을 만큼 불산 관악에 대한 두려움을 컸다.
이같은 풍수적 해석을 적용, 숭례문은 제 몫을 다 했다는 주장도 나온다. 경복궁·청와대로 꽂히는 관악산 화력을 방어하는 1차 방화벽으로 기능했다는 것이다. 숭례문이 없었다면 배후의 궁궐이 불에 휩싸인다는 풀이도 적어도 풍수상으로는 가능하다.
건축사 조인철 박사의 설명은 숭례문 화재가 경복궁을 보호한 것일 수 있다는 강변에 무게를 싣는다. 조 박사는 "도로살을 직접 받는 터에서는 불이 나기 쉽다"고 전제했다.
이어 "조선시대에는 경복궁으로 직행하는 직살을 피하려고 T자형 도로를 닦았다. T자 도로는 남대문을 통해 중앙 우체국 앞을 지나 종각으로 이어지다 종로에서 좌회전, 세종로로 연결됐다. 경복궁행 직살을 피하기 위해 만들었다"고 풀이했다.
이와 별개로 새 정권 탄생을 앞둔 '저주'라는 견강부회도 나돌고 있다. 기존의 청와대 엠블럼 속 쌍봉황을 없애려는 움직임이 남향을 지키는 주작, 즉 봉황을 진노케 했다는 설이다. 25일 국회에서 열리는 대통령 취임식 엠블럼은 태평고(太平鼓)다. 봉황은 없다.
숭례문
결국 화마(火魔)의 무서운 기세에 국보 1호 숭례문(崇禮門.남대문)이 힘없이 무너져 내렸다.
임진왜란과 병자호란 등 수차례의 전란(戰亂)을 견뎌온 성문이 한순간의 화재에 무릎을 꿇은 것이다.
관악산의 화기(火氣)를 누르기 위하여 양녕대군이 세로로 썼다고 전해지는 숭례문의 현판도, 화재 등 재난을 막아준다는 장식물 치미(망새)도 화재 피해를 막아내지 못했다.
10일 오후 방화로 추정되는 화재가 발생해 붕괴된 숭례문은 현재 서울에 남아있는 목조건물 중 가장 오래된 것이다.
지난 1962년 12월 국보 1호로 지정된 명실상부한 국내 대표 문화재로 현존하는 한국 성문 건물로서는 가장 규모가 큰 것이기도 하다.
숭례문은 조선왕조가 한양 천도 후인 1395년(태조4년)에 한성 남쪽의 목멱산(木覓山.남산)의 성곽과 만나는 곳에 짓기 시작해 1398년(태조7년)에 완성됐으며 이후 500년 동안 몇 차례의 보수를 거쳐 지금까지 전해지고 있다.
현재 남아있는 건물은 1447년(세종29년)에 고쳐 지은 것인데 1960년대 초반 해체, 보수 과정에서 발견된 발견된 상량문(上樑文)을 통해 1479년(성종10년)에도 한 차례의 대규모 보수 공사가 있었다는 사실이 밝혀지기도 했다.
한국전쟁으로 인한 피해를 복구하기 위해 1961-1963년의 대규모 해체, 보수공사를 한 후에는 몇차례의 소규모 정비 공사만이 진행됐다.
1960년대 공사 당시에 제거했던 옛 목부재와 기와 등 350여점은 숭례문 내에서 보관하다가 2005년 한국전통문화학교 부재보관소로 옮겨 다행히 이번 화재 피해를 피해갔다.
숭례문은 1907년 일제가 연결된 성곽을 허물고 도로를 내면서 대로에 둘러싸여 고립돼 있다가 2005년 5월 숭례문 주변에 광장이 조성되고, 2006년 3월에는 100년 만에 중앙 출입문인 홍예문이 개방되면서 일반인들의 접근이 가능해졌다.
이러한 과정을 겪으며 500년을 지켜온 숭례문에 화재가 발생한 것은 이번이 처음이다.
또 지난 1984년 보물 163호였던 쌍봉사 대웅전이 불 타고 2005년 산불로 보물 479호인 낙산사 동종이 소실되는 등 화재로 인한 문화재 피해 사례는 몇차례 있었지만 국보급 건축물이 화재로 전소된 것도 이번이 처음이다.
이처럼 국보 1호가 화재로 사라지는 믿기 힘든 일이 벌어지면서 목조 문화재의 취약한 방재 관리도 다시 도마에 오를 수 밖에 없게 됐다.
실제로 숭례문에는 소화기 8대가 1,2층에 나뉘어 비치되고, 상수도 소화전이 설치된 것이 소방시설의 전부이며 감지기 등 화재 경보설비나 스프링클러 등은 설치돼 있지 않았다.
또 홍예문이 개방되는 오전 10시에서 오후 8시 사이에 평일 3명, 휴일 1명의 직원이 상주하며 관리하지만 그 이후에는 사설경비업체의 무인경비시스템에 의존하고 있다.
따라서 이날과 같이 홍예문 폐쇄 시간에 발생한 화재 상황에 대해서는 신속한 대처가 어려운 상황이었다.
특히 숭례문은 야간 조명시설이 설치돼 있어 누전 등 전기 사고의 가능성이 있는 데다 일반인들의 접근이 쉬워 방화 위험도 비교적 큰 편이다.
문화재청은 2005년 4월 낙산사 화재 이후 중요 목조문화재가 산불 등으로 소실되는 것을 막기 위해 중요 목조문화재 방재시스템 구축사업을 추진하고 있으며, 지난해 1차로 해인사, 봉정사, 무위사, 낙산사 등 4곳에 수막설비, 경보시설 등을 설치했다.
숭례문도 우선 구축대상인 중요 목조문화재 124개에 포함돼 있으나 아직까지 방재시스템이 구축되지 않은 상태다.
지난해에는 숭례문 지붕 위에 있는 작은 흙 인형인 잡상(雜像, 어처구니) 중 하나가 훼손된 채 수개월째 방치돼 관리체계에 문제가 제기되기도 했다.
이번에 붕괴된 숭례문이 다시 제 모습을 찾기까지는 상당한 시일이 소요될 것으로 보인다.
다행히 최근 숭례문 실측 도면을 제작해 둔 상태이기 때문에 원형 복원이 가능하지만 피해 규모에 따라 1년 이상의 복원 기간이 소요될 것이라고 문화재청 관계자는 전했다.
화재경과
설 연휴 마지막날인 10일 저녁 국보 1호인 숭례문에서 방화로 추정되는 큰 불이 나 1,2층 누각이 전소돼 무너져 내리는 막대한 피해가 발생했다.
소방당국은 5시간 넘게 진행된 진화 작업에도 숭례문 붕괴를 막지 못했고, 방화 용의자에 대한 경찰의 수사도 어려움을 겪고 있다.
◇ 발화 순간 = 서울 중구 남대문 4가 숭례문에서 불길이 치솟기 시작한 것은 10일 오후 8시50분께.
화재 장면을 목격한 택시기사 이모(44)씨는 "근처에서 손님을 기다리고 있었는데 50대 정도로 보이는 어떤 남성이 쇼핑백을 들고 숭례문 옆 계단으로 올라갔다"며 "불꽃놀이를 하듯이 빨간 불꽃이 퍼져나와 신고를 했다"고 말했다.
소방 당국은 신고를 받고 펌프차와 고가 사다리차 등 소방차 32대와 소방관 128명을 현장에 출동시켜 진화 작업에 들어갔다.
누각 2층 지붕에서 발생한 불로 목재가 타면서 주변이 온통 하얀 연기로 뒤덮혔으나 소방관들은 `국보 1호'라는 문화재 특성상 훼손을 우려한 나머지 일반 건물처럼 적극적인 진화 작업을 펼치지는 못했다.
◇ 초기 진화 실패 = 타오르던 불길이 발화 40여분만인 오후 9시30분께 거의 사그라지면서 `훈소상태'(연기만 나는 상태)가 되자 현장에 출동한 소방관들은 한때 불이 잡힌 것으로 착각했다.
그러나 기와 안쪽에 남아있던 불씨가 완전히 꺼지지 않고 남아있다가 곧 다시 맹렬한 기세로 번져나가기 시작했다.
소방당국은 오후 9시35분께 문화재청으로부터 "화재진압이 우선이니 국보인 남대문의 일부를 파기해도 된다"는 협조를 얻어낸 뒤 현판 일부를 잘라내고 본격적인 진화에 나섰다.
소방당국은 9시55분에 화재비상 2호를, 40여분 뒤 이 보다 한단계 높은 화재비상 3호를 각각 발령하는 등 총력을 기울였으나 연기는 좀처럼 줄어들지 않았다.
발화지점으로 추정되는 기와 안쪽의 `적심' 부분이 전통 목조건물의 방수처리 공법으로 처리돼 있어 아무리 물을 뿌려도 소용이 없었다.
화재 진압팀은 오후 11시20분께 냉각수 대신 거품식 소화 약제를 뿌리기 시작했으나 역시 큰 효과를 보지 못했다.
◇ 결국 붕괴로… = 숭례문 지붕을 해체해야 한다는 판단에 따라 화재 발생 3시간 만인 오후 11시50분께부터 전격적인 `마구잡이' 지붕 해체 작업이 시작됐다.
그러나 앞서 진화 작업을 위해 뿌린 물이 얼어 붙는 바람에 소방관들이 지붕에 접근하는 것조차 어려움을 겪는 사이 불길은 점점 더 번져나갔다.
자정을 넘어 불은 2층 전체를 휘감아 누각 곳곳을 뚫고 5~10ｍ 높이에 이르는 거대한 불기둥을 뿜어댔다.
숭례문 2층 누각은 11일 0시58분께 서울역을 바라보는 뒷면부터 우수수 무너져내리기 시작해 삽시간에 붕괴로 이어졌다.
결국 발생 5시간만인 오전 1시54분께 진화 노력도 헛되이 누각 2층과 1층 대부분이 `와르르' 무너지면서 600년 역사를 자랑하는 국보가 허망하게 사라지고 말았다.
◇ 화재 원인 및 수사 = 택시 기사 이씨 등 목격자 진술에 따르면 이번 화재는 직전에 숭례문에 올라갔다가 내려온 50대 남성의 방화로 발생했을 가능성이 높은 것으로 추정된다.
이 남성은 항공점퍼와 검은색 등산바지를 입고 있었고 불이 난 뒤 계단을 내려와 유유히 걸어서 도망갔다고 이씨는 전했다.
화재 직전 무인경비시스템에 외부인 침입 사실을 알리는 경보가 울렸다는 점도 방화 가능성에 무게를 실어주고 있다.
숭례문 무인경비서비스를 제공하는 KT텔레캅 관계자는 "경보가 울려서 현장에 나와보니 불이 나 숭레문이 타고 있었다"고 전했다.
경찰은 이씨가 진술한 50대 방화 용의자와 인상착의가 비슷한 A(55)씨를 현장 부근에서 붙잡아 조사를 벌였으나 알리바이가 확인돼 귀가조치했다.
숭례문에 설치된 전기 조명시설에서 누전이나 전기합선으로 불이 난 것이라는 분석도 나오지만 가능성은 낮아 보인다.
조명시설이 발화지점으로 추정되는 2층 지붕이 아닌 1층 지붕에 있으며 불이 난 이후에도 한 동안 켜져 있었다는 점에서 누전 가능성이 낮다고 전문가들은 입을 모았다.
한국전기안전공사 관계자는 "지붕 2층에는 전기시설이 아예 없고 1층에는 조명이 있지만 누전차단기가 설치돼 있어 누전시 바로 차단이 된다"며 누전에 의한 화재일 가능성은 낮아 보인다고 설명했다.
경찰은 일단 방화와 누전 등 모든 가능성을 염두에 두고 조사를 벌이고 있으며 화재 당시 상황이 찍힌 주변 건물 등의 폐쇄회로(CC)TV를 확보하는 데 총력을 기울이고 있다.
◇ 피해 규모는 = 숭례문의 붕괴는 명실상부한 국내 대표격 문화재인 `국보 1호'의 소실이라는 점에서 재산 손해액수로만 계산할 수 없는 유ㆍ무형의 막대한 피해를 남겼다.

11일 새벽 0시40분쯤 화마(火魔)가 삼켜버린 국보 1호 숭례문(崇禮門) 2층이 불을 이기지 못하고 무너져 내리기 시작하자 이를 지켜보던 시민들의 입에서는 "어떻게 이럴수가!"라는 탄식과 비명이 이어졌다.
"어, 어, 무너진다!"
고등학생인 정영진(18·서울 효자동)군은 "저녁 뉴스 보다가 부모님과 택시 타고 왔다. 방금 도착했다"며 "비참하다, 참담하다"만 연발했다.
화재가 발생한 지 4시간여 지난 이날 새벽 0시50분쯤 숭례문 2층이 무너져 내리고 기왓장이 떨어지기 시작하자 숭례문 주변 여기저기서 "악!" "어떡해!"라는 비명소리가 들렸다. 연기가 자욱했던 숭례문 2층 지붕에서 불기둥이 솟아올랐다.
이 광경을 목격하고 있던 일본인 관광객 아사 오카(45)씨는 "테러블(terribe), 테러블!"을 연발했다. 아사 씨는 "근처 호텔에서 연기를 보고 나왔다"며 "일본에서는 상상도 할 수 없는 일이다. 국보 1호 아니냐"고 말했다.
황평우 문화유산 위원장은 ytn인터뷰에서 "소방당국은 2시간 동안에 멀리서 물만 쏘고 있었다. 지금은 또 물이 떨어져서 소방차 교체한다고 소방차 뺐다… 불이 또 번지고 있다"며 안타까워했다.
중학교 2학년 아들과 고등학교 1학년 딸을 데리고 도심에 나온 구복회(여·47)씨는 "2008년 연초에 국보 1호가 이렇게 무너지는 것을 보니까 안타깝다"며 아이들을 감싸 안았다.
현장에서 4시간째 화재를 지켜봤다는 유해신(59·택시기사)씨는 "대한민국이 무너져 내렸다"며 "국보는 우리나라 얼굴 아니냐. 울화통이 터진다. 보니까 일할 맛이 안 난다. 평소 지키는 사람이 한 명도 없었다"며 분통을 터뜨렸다.
시민들 숯덩이 같은 잔해에 헌화 물결 -"美자유의 여신상 무너진 꼴" 울분도
“나라의 보물인데 밤이 되면 정부는 손 놓고 민간 용역업체가 관리한다는 게 말이 됩니까.”
11일 오후2시 서울 중구 남대문로4가 숭례문 화재사고 현장. 웅장했던 ‘국보 1호’의 위용은 온데 간데 없이 거짓말처럼 사라졌다. 남은 것은 숯덩이처럼 시커멓게 그을린 잔해뿐이었다. 시민들은 그 참혹한 모습에 할 말을 잃은 표정이었다.
전소(全燒)된 숭례문에 대한 죄스러움에 헌화의 물결이 이어졌다. 흰 조화를 바치며 엎드려 흐느끼는 사람들도 적지 않았다. 경기 남양주시에 사는 이보람(23ㆍ여)씨와 김준국(22)씨는 흰 국화꽃을 바친 뒤 “너무나 가슴이 아파 아침에 집을 나섰다”며 “막상 눈으로 직접 보니 하늘이 뻥 뚫려버린 것 같아 너무나 슬프다”고 아쉬워했다.
상당수 시민들은 착잡한 표정과 함께 휴대폰과 카메라로 숭례문을 사진 속에 담았다. 아마추어 사진작가 김용연(38)씨는 “다시 복원이야 되겠지만 이런 일이 있었다는 기록을 남겨야 한다는 생각에 카메라를 들고 나왔다”고 말했다.
이날 수천 명의 시민이 찾은 숭례문 앞은 정부에 대한 성토장이 됐다. 시민 사이에서는“도대체 경비를 어떻게 했나” “미국의 자유의 여신상, 프랑스의 에펠탑, 중국의 자금성이 무너진 꼴”이라는 탄식이 곳곳에서 터져 나왔다.
10대 시절 3년간 숭례문 인근에서 살았다는 정순녀(68ㆍ여)씨가 “정부가 직접 관리하지 않고 용역을 줬다니 이해할 수 없다”며 눈물을 글썽이자, 시민들 사이에서 “나라가 도대체 무엇을 한 것이냐”“맞아 맞아”하는 동조의 외침이 잇따랐다. 정씨는 한숨을 쉬며 “복원한다 해도 소 잃고 외양간 고치는 꼴 아니냐”며 “국산 나무도 없다는 데 이 얼마나 창피하고 부끄러운 일이냐”고 가슴을 쳤다.
일본에 살다 지난해 귀국했다는 강경자(56ㆍ여)씨도 “조상의 얼이 담긴 유산을 제대로 지켜내지도 못한다면 우리는 도대체 무엇에 긍지를 느끼며 살아가야 하냐”며 “고궁의 수문장 교대식을 보면서 ‘이제 우리 나라도 잘하는구나’ 생각하고 뿌듯했는데 다 수박 겉핥기였다는 생각이 든다”고 말했다. 한 시민은 “불이 났으면 일단 끄고 봐야지 전화기만 붙잡고 있었다는 게 이해 안 된다”며 고개를 절레절레 저었다.
어린이들의 눈에도 이번 화재는 충격 그 자체였다. 겨울방학을 이용해 서울에 놀러 왔다 할머니와 함께 화재 현장을 찾은 충북 제천시의 임현규(11)군과 동생 지윤(9ㆍ초등 2년)양은 “우리 문화재를 지키지 못해 안타깝지만 결국 우리 모두의 책임인 것 같다”고 어른들 모두를 향해 뼈있는 한마디를 건넸다.
서울의 명소였던 숭례문의 소실을 슬퍼하는 목소리도 높았다. 대학생 김기현(26)씨는 “시내 외출 때마다 봐 왔기에 일상의 한 부분 같았는데, 이렇게 돼 멍하다”며 상실감을 토로했다. 한 달 간 한국으로 여행을 왔다는 루이즈 캘러허(21ㆍ여ㆍ오스트레일리아)씨도 “너무나 큰 비극인 것 같고, 다른 나라 사람들도 많이 보고 즐기는 관광지였는데 큰 손실을 입은 것 같다”며 유감의 뜻을 표했다. 지방의 한 어린 네티즌은 “아직 한 번도 보지 못했는데 이렇게 없어지면 어떻게 해요”라는 글을 올리기도 했다.
숭례문 방화범 처벌-최고 무기징역 가능
10일 발생한 숭례문 화재 원인이 방화로 추정되는 가운데 방화범은 최고 무기징역을 선고받게 되는 등 중형을 피할 수 없다.
우선, 방화범은 국보 제1호라는 국가지정문화재에 불을 지펴 전소시켰기 때문에 문화재보호법의 적용을 받는다.
문화재를 보호하기 위해 제정된 문화재보호법은 인위적이거나 자연적으로 형성된 국가적ㆍ민족적ㆍ세계적 유산으로서 학술적ㆍ경관적 가치가 큰 것을 `문화재'로 규정하고 있다.
이 법 제106조는 국가지정문화재나 가지정문화재 건조물에 대해 방화를 저지른 자에 대해 형법을 따르도록 하고 있는데, 형법 제165조는 공용건조물 등에 불을 놓아 이를 훼손한 경우 무기 또는 3년 이상의 징역에 처한다.
따라서 방화범은 최대 무기징역이나 3년이상 15년 이상의 유기징역에 처해진다.
양형을 정하는 데 있어 방화범이 범행을 저지른 동기 등 여러가지 사안들이 참작이 되지만 피해 결과를 감안할 때 결코 가볍지 않은 형이 선고될 가능성이 크다는 것이 중론이다.
숭례문이 600년 이상된 국보 제1호라는 점에서 그 가치를 금액으로 환산할 수 없고, 대부분 전소돼 손괴의 정도가 심각하다는 것이다.
피해가 회복될 수 있느냐는 측면에서 숭례문이 과거 문화재를 본 따 만든 복원된 것이 아니라 지어진 당시의 모습을 유지하고 있어 회복이 불가능하다는 점도 방화범에게는 불리한 요소로 작용한다.
그 동안에는 문화재가 방화 등으로 훼손됐긴 했지만 국보급이 아닌데다가 피해 정도도 그다지 크지 않아 비교적 가벼운 실형이나 집행유예를 선고받았다.
2006년 5월 수원 화성(사적 제3호) 서장대에 불을 질러 목조 누각 2층을 태운 20대 남성은 징역 1년6월의 실형을 선고받았고, 앞서 4월 창경군 문정전(사적 제123호)에 불을 질러 400여만원의 재산 피해를 낸 방화범은 집행유예를 선고받았다.
또 2005년 4월에는 보물 479호인 낙산사가 소실됐지만 이는 방화가 아닌 산불에 의한 것이었다.
따라서 국보급의 완전 소실을 야기시킨 이번 숭례문 방화범은 문화재의 가치나 그 피해정도 등을 감안하더라도 중형을 면할 수 없다는 것이 대체적인 시각이다.
한편, 문화재보호 관리당국자들에 대한 형사처벌도 피할 수 없어 숭례문을 보수 관리 해야 할 최종 책임자가 누구냐에 따라 관리부실 책임 등을 물어 문화재보호법 위반이나 직무유기 등이 적용될 수 있다.
